BCBS Customers Await Settlement Payments from $2.67B Antitrust Case
Blue Cross Blue Shield (BCBS) customers are eagerly awaiting their share of a $2.67 billion antitrust class-action settlement, with payments slated to commence in May 2026. This development comes after the resolution of court appeals, bringing closure to a lawsuit initiated over a decade ago. Eligible claimants have begun receiving determination notices via email and postcards, solidifying their participation in this landmark case.
Initially filed in 2013, the lawsuit accused the Blue Cross Blue Shield Association and its affiliated plans of breaching federal antitrust laws through alleged non-competition agreements in the sale of health insurance and administrative services across the U.S. and Puerto Rico. Although BCBS has steadfastly refuted these allegations, the association opted for a settlement to circumvent extended legal procedures, finalizing the agreement on October 16, 2020.
The settlement encompasses approximately six million claims submitted before the established deadline, with individual payouts projected to average between $300 and $333. After deducting legal fees and administration costs, the settlement fund totals about $1.9 billion. Eligible participants include individuals and fully insured groups under BCBS health insurance or administrative services from February 7, 2008, to October 16, 2020, excluding government accounts, dependents, beneficiaries, and non-employees.
