Legal reforms in Florida are contributing to a significant drop in new lawsuit filings, with numbers having decreased by 50% since peaking during the insurance crisis in 2020, as per the Florida Office of Insurance Regulation's Property Insurance Stability Report. This decline is pivotal, given the state’s historic challenge with high litigation rates, which have previously driven up costs for insurers and, consequently, policyholders. Meanwhile, the first half of 2026 saw average home insurance premiums drop in 51 of Florida's 67 counties, with the current statewide average premium at $3,757. This reduction is attributed to insurers working with regulators to maintain or even decrease rates.

Market Potential and Upcoming Challenges

As lawsuit numbers decrease, insurers expect to save on legal expenses, which could lead to further premium reductions for policyholders. Lower legal costs can also reduce reinsurance expenses, potentially drawing more insurers to Florida's market. Since 2023, for example, 21 insurance carriers have started operating in the state, suggests data from Triple-I. However, rising inflation, increased construction costs, labor shortages, and tariffs could inflate rebuilding costs after damages, posing challenges to sustained market progress.
