Recent Developments in International Arbitration: Key Cases and Insights
The Institute of Transnational Arbitration, in collaboration with the ITA Board of Reporters, has unveiled the most recent ITA Arbitration Report. This comprehensive report provides critical updates on arbitration awards, cases, legislation, and developments across more than 60 countries and 12 institutions, highlighting the evolving landscape of international arbitration.
In the notable case of Abara Johnson v. TitleMax of Virginia, Inc., the arbitrator, operating under JAMS Comprehensive Arbitration Rules, determined that TitleMax unlawfully issued high-interest loans in North Carolina without proper licensure. Despite the contract's Virginia law clause, North Carolina law prevailed, leading to a finding of breach against TitleMax for violating state consumer finance regulations, and awarding the claimant over $246,000 in damages and interest.
Another significant ruling occurred in American Income Life Insurance Company v. Valentino Kalaj under AAA Commercial Arbitration Rules. Kalaj was found liable for contract breaches and trade secret misappropriation. His non-participation in proceedings resulted in a favorable ruling for American Income Life, including substantial damages and a permanent injunction.
Complex Arbitration Cases and Rulings
In Linda Davis v. TitleMax of Virginia, Inc., the arbitrator voided the Virginia choice-of-law clause in the loan agreement, enforcing North Carolina law due to public policy concerns. Similarly, in Lenka Investments Limited v. E21 Partners Technology SL, the arbitration explored jurisdictional issues related to a defaulted $5 million loan.
The emergency arbitration in Mattress By Appointment LLC v. Haitham Belbaisi and others issued an injunction to prevent misuse of confidential information and solicitation breaches in a dealer agreement. Additionally, United Nurses and Allied Professionals v. Prospect Charter Care LLC resulted in a modified termination to suspension, taking into account the nurse’s long service and expressed remorse.
In the commercial case of Bristol Consulting Group, Inc. v. Shotclock, LLC, negligence claims were dismissed as the arbitrator deemed criminal acts during filming unforeseeable. In the dispute of Enerfo Pte Ltd v. AA7 Foods and Beverages LLC, the tribunal enforced payment for an unpaid sugar shipment but dismissed other claims.
