West Bend Insurance Seeks Court Ruling on Injury Claim Responsibilities
West Bend Insurance Company is pursuing legal action to clarify its obligations related to an injury claim involving a policyholder. The insurer has submitted a request to the U.S. District Court for the Middle District of Florida for a declaratory judgment to determine its responsibilities before any financial settlement.
The company involved, Trees R Us, Inc., holds a commercial policy from West Bend, effective from November 15, 2022, to November 15, 2023. This legal case follows an incident where employee Michael Ray O'Dell filed a lawsuit after sustaining injuries during a job in Florida, implicating Trees R Us and its officers.
While West Bend is currently covering legal defense costs for Trees R Us and its officers, the insurer maintains a reservation of rights. This allows West Bend to dispute coverage and potentially rescind the policy in accordance with various exclusions within its coverage, including Commercial General Liability, Tree Care Professional Liability, Business Auto, and Commercial Liability Umbrella policies.
The policy's exclusions are pivotal in the dispute, notably the employer's liability and workers' compensation exclusions, which negate coverage for employee injuries sustained during work and liabilities under statutory compensation laws. O'Dell has also filed a workers' compensation claim under Florida law, further complicating the issue.
Additionally, the policy includes specific endorsements excluding coverage for operations like line clearing and power disconnection, pertinent to the storm-related tasks described in the filings. West Bend is also pursuing policy rescission, alleging that Trees R Us misrepresented its operational scope during the application, asserting activities were limited to Illinois, Wisconsin, and Indiana while extending operations to Florida.
The insurer argues this misrepresentation was intended to deceive, justifying rescission under Illinois law and offering a refund of premiums if the policy is voided. West Bend also seeks to recoup all defense costs incurred, based on common law and the policy's Defense Costs endorsement.
Although O'Dell is a party in the proceedings, West Bend is not seeking a judgment against him directly, only that he adheres to the court's final decisions. The court has yet to assess the allegations, and no responses or judicial determinations on policy exclusions or rescission have been made by the defendants.
