Liberty Mutual Drops Coverage Lawsuit Against Mars Over Marketing Practices

Liberty Mutual Insurance Company has voluntarily dismissed its lawsuit against Mars Inc. in the U.S. District Court for the Eastern District of Virginia. The case centered on whether Liberty Mutual was obligated to provide coverage for Mars' defense in a lawsuit alleging the candy giant knowingly marketed ultra-processed foods to children, despite known health risks.

 Liberty Mutual argued that its commercial general liability policies did not cover intentional misconduct, which the lawsuit against Mars was based on. Insurance coverage typically applies to accidents, not deliberate actions, making the legal determination complex. The dismissal was without prejudice, leaving the possibility for Liberty Mutual to refile in the future.
