NABIP Policy Update: Key Changes in Medicare Advantage and Part D Eligibility

The National Association of Benefits and Insurance Professionals (NABIP) has announced policy updates stemming from the Centers for Medicare & Medicaid Services (CMS) Final Rule for the 2027 Medicare Advantage and Part D programs. These changes are expected to benefit insurance agents, brokers, and Medicare beneficiaries significantly.

The final rule aligns with NABIP's advocacy efforts to refine Medicare marketing and communication regulations. The focus is on reducing administrative tasks, enhancing the experience for Medicare beneficiaries, and facilitating better interactions with licensed agents and brokers, all while maintaining essential consumer protections.

Key Changes in the Final Rule

  • Elimination of the mandatory 48-hour waiting period post-Scope of Appointment agreement, which NABIP argued impeded beneficiaries’ access to timely information.
  • Enhanced flexibility for educational and marketing events, allowing Scope of Appointment forms to be collected at these events and enabling immediate marketing activities afterward, provided beneficiaries are informed and can choose to leave.
  • Adjustment of the timing for TPMO disclaimers, moving from the first minute of a call to just before plan benefits are discussed, allowing basic information gathering before mandatory disclosures.

Additionally, CMS has accepted NABIP’s suggestion to reduce the retention period for audio recordings of marketing and sales calls from ten years to six years. This change eases data management pressures and aligns with other federal standards, requiring audio recordings in the first three years and allowing for either audio or a complete transcript retention in years four to six.
