Texas House Bill 2067 Enhances Transparency in Auto and Home Insurance

A recent legislative change in Texas, enacted through House Bill 2067, now requires insurers to automatically deliver written explanations when they decline, cancel, or do not renew auto and home insurance policies. This initiative aims to bolster transparency and accountability across the insurance sector, promoting clearer communication between insurers and policyholders.

Previously, Texas law mandated that insurance carriers only provide such explanations upon formal request by consumers. The new regulation compels insurers to submit quarterly reports to the Texas Department of Insurance (TDI), detailing the reasons behind their decisions. These updates to the Texas Insurance Code will apply to any decisions made after January 1, 2026, enhancing regulatory compliance and oversight.

TDI's Implementation Strategy

The Texas Department of Insurance has devised a structured, three-phase plan to implement these reporting obligations. Initially, the focus will be on residential property and private passenger automobile insurance data. This will be followed by guidelines on reporting for commercial insurance lines under the Texas Commercial Lines Statistical Plan. The final phase will consider frameworks for other property and casualty lines not currently included in TDI’s data collection but subject to the new law.

Consumers who do not receive the required written justification from their insurers can seek redress by lodging a complaint with the TDI.
