Reinstating ACA Abortion Coverage Transparency

U.S. Senator Cindy Hyde-Smith has called for the reinstatement of a rule that ensures transparency about whether Affordable Care Act (ACA) insurance plans include abortion services.

Senator Hyde-Smith, leading the Senate Pro-Life Caucus, is reacting to a Government Accountability Office (GAO) report indicating a significant number of ACA Qualified Health Plans (QHPs) that cover abortions receive federal subsidies. This development has raised questions about compliance with the Hyde Amendment, which prohibits federal funds from being used for abortion services. According to the GAO report titled "Health Insurance Exchanges: Coverage of Non-Excepted Abortion Services by Qualified Health Plans, 2026," approximately 1,719 ACA QHPs covering around 4.4 million individuals include elective abortions.

Industry Concerns and Historical Context

Since the GAO's last assessment in 2014, the number of ACA QHPs providing abortion coverage has increased by 683, highlighting potential regulatory gaps. The previous administration's Exchange Program Integrity Final Rule in 2019 aimed to maintain separate billing for abortion services to comply with Section 1303 of the ACA. However, the rule was altered in 2021, a change some perceive as undermining the Hyde Amendment's principles. This situation underscores persisting compliance challenges for insurance carriers and brokers navigating these regulations.
