Louisiana Suspends Insurance Cancellations Post Tropical Storm Arthur
Louisiana Insurance Commissioner Tim Temple has announced a temporary suspension of certain insurance cancellations and deadlines for residents in seven parishes impacted by Tropical Storm Arthur. This emergency action provides additional time for policyholders to manage premium payments and claims during the recovery phase, ensuring they meet regulatory compliance requirements effectively.
Emergency Rule 50, enacted by Temple, modifies state insurance regulations concerning policy cancellations, terminations, nonrenewals, and other underwriting aspects related to premium payments and claim filing deadlines for affected individuals. This measure responds to widespread flooding and isolated tornadoes across Louisiana, prompting emergency declarations. The rule offers protection to residents as they transition from dealing with immediate storm impacts to recovery, granting additional time to handle insurance obligations without risking coverage loss.
The suspension aligns with the emergency declaration by Governor Jeff Landry, covering several parishes, including Avoyelles, Lafourche, Pointe Coupee, Rapides, St. Landry, St. Tammany, and Terrebonne. Insurers are generally restricted from canceling, terminating, or refusing to renew policies affected by the storm during this period. The objective is to provide temporary relief to residents, allowing them to prioritize recovery activities without immediate insurance coverage concerns.
In addition, homeowners may face the activation of separate named storm insurance deductibles due to the storm's classification by the National Hurricane Center. This could result in deductibles based on a percentage of the home's insured value, impacting claims processing. Emergency Rule 50 is effective from June 18 through July 22, exclusively for policyholders within the declared emergency area. Others remain subject to standard insurance requirements.
