Wisconsin Special Enrollment Period: FTC Lawsuit Impact on Health Plans

The Wisconsin Office of the Commissioner of Insurance has announced a special enrollment period for residents who purchased healthcare plans from Innovative Health Plan, Healthcare Plan, or ACLP Health Plan. This initiative follows a lawsuit by the Federal Trade Commission against Innovative Partners, LP and American Collective, LP. The lawsuit claims these entities marketed plans misrepresented as comprehensive coverage, but were in fact medical discount memberships and limited benefit plans.

According to the lawsuit, these plans failed to provide adequate coverage, potentially burdening consumers with high out-of-pocket medical expenses. Affected individuals now have access to an extended special enrollment period for comprehensive Marketplace plans, which will remain open until August 10, 2026. Eligibility for enrollment is determined by the Centers for Medicare and Medicaid Services, aiming to ensure affected consumers receive appropriate coverage.

The court has placed the implicated companies into receivership to manage their assets and explore restitution options for those misled by the plan offerings. Affected consumers are encouraged to complete a verification form available on the official website to confirm their involvement. The receiver will compile a list of those impacted, with notifications sent via email and postal mail. For updates on potential unresolved claims and general inquiries, individuals can visit the designated website or contact the official email support for assistance.
