California Senate Bill 1301 Enhances Homeowners Insurance Transparency

A legislative proposal aimed at enhancing transparency for homeowners regarding nonrenewal of insurance policies has successfully passed the Assembly Insurance Committee in California. Senate Bill 1301, introduced by Senator Ben Allen and supported by Consumer Watchdog and the Every Fire Survivor's Network, seeks to address concerns from residents, especially those impacted by wildfires, about the retention of homeowner’s insurance coverage.

Under the proposed legislation, insurers would be required to provide detailed explanations for policy nonrenewals, including specific reasons and supporting evidence. Additionally, the bill mandates clear guidance from insurers on how policyholders might rectify issues that could lead to losing coverage. The bill also aims to prevent insurers from dropping policies solely due to factors such as the age of the roof or previous claims.

California faces a high rate of homeowner insurance nonrenewals across the United States. Nearly one million residents have turned to the FAIR Plan, known for limited coverage and higher costs, or have sought coverage from surplus lines insurers in recent years. Carmen Balber from Consumer Watchdog emphasizes the need for transparency, stating that "consumers have a right to know the rules." Senator Allen highlights the bill’s importance in maintaining housing stability and protecting residents from disaster risks by ensuring they have adequate time and information to address insurability issues. Joy Chen from the Every Fire Survivor's Network underscores the bill's role in stabilizing the housing market by safeguarding access to essential insurance coverage.

The bill requires insurers to clearly outline steps needed to maintain coverage, enabling homeowners to respond appropriately. Magda Molina, who testified in favor of the bill, shared her experience of making repairs to meet insurance requirements, only to find it insufficient to continue coverage. Polling indicates that over 90% of Californians support extended notice periods for nonrenewals, along with ample time for necessary improvements.

As part of a series of insurance reforms, SB 1301, alongside two other bills concerning consumer insurance benefits, will proceed to the Assembly Appropriations Committee for further consideration.
