Legal Dispute Between Broward Health and Florida Blue Over Emergency Services

A legal dispute has arisen between Broward Health, part of North Broward Hospital District, and Florida Blue regarding compensation for emergency services delivered to out-of-network patients. Broward Health claims that Florida Blue, operating under Blue Cross Blue Shield of Florida, did not adequately reimburse them for the necessary medical services provided to policyholders.

The disagreement intensified after Broward Health's contract with Florida Blue ended on July 1, 2025, following unsuccessful negotiations. Under the regulatory compliance mandates of Florida law and the federal EMTALA statute, hospitals are required to offer emergency treatment irrespective of insurance or network affiliations.

On April 7, Broward Health filed a lawsuit seeking compensation for underpayments related to a significant volume of emergency services rendered to Florida Blue's commercial plan members who were out-of-network. While specific figures remain undisclosed, the hospital claims an ongoing accrual of interest on these amounts. The lawsuit alleges that Florida Blue either failed to pay or reimbursed at rates below the hospital's charges and those typical for similar community services. Broward Health contends no agreement on reduced rates existed and accuses Florida Blue of unauthorized discount applications.

Florida Blue has not yet provided a formal legal response. However, spokesperson Jorge Martinez stated that the company refrains from discussing active litigation, keeping its focus on maintaining regulatory compliance and risk management.

Broward Health is pursuing a 12% annual interest on the amounts owed by Florida Blue. The hospital has requested that the court transfer the case to its complex business litigation division, noting the dispute involves a sum exceeding $750,000, excluding interest and additional fees. Additionally, Broward Health seeks judicial determination of appropriate rates Florida Blue should pay for out-of-network emergency care during the litigation process.

The termination of the contract has resulted in thousands of Florida Blue members in Broward County losing in-network coverage at Broward Health facilities. While Broward Health advocates for increased reimbursement rates due to rising operational costs, Florida Blue argues that such demands are unreasonable, potentially resulting in higher premiums for policyholders.

This impasse affects access for policyholders to more than 11 hospitals, including Joe DiMaggio Children's Hospital, in Broward County. Similar conflicts, such as a dispute between Florida Blue and Memorial Healthcare System, further limit network access. This issue reflects a broader trend across the country, as seen in a related case where HCA Healthcare filed a lawsuit against UnitedHealthcare in February 2025, seeking full compensation for emergency services without discounted rates. That case is still pending in state court.
