Illinois House Bill 5408 Advances Abortion Fund for Health Insurers
In Illinois, health insurance policyholders might soon contribute automatically to a grant program aimed at supporting abortion services for women lacking adequate insurance coverage. House Bill 5408, proposed by Representative Anna Moeller, D-Elgin, has successfully passed the Illinois House and is advancing to the Senate. This proposed legislation seeks to create an Abortion Access Fund under the Illinois Department of Public Health, targeting the allocation of 90% of unused Health Insurance Carrier funds set aside under the Affordable Care Act for abortion services.
During the House discussions, Moeller highlighted similar legislative efforts in California and Maryland, using them as precedents. While she acknowledged the insurance industry's concerns late in the process, potential amendments are anticipated in the Senate. The Affordable Care Act requires that insurance plans covering abortion allocate a minimum of $1 per enrollee monthly, with remaining unused funds directed into this new initiative.
Questions were raised by Rep. Regan Deering, R-Decatur, about any potential link to Governor J.B. Pritzker's Prairie State Access Fund, which collaborates with philanthropic entities. Moeller clarified that these funds would operate independently. However, Rep. Adam Niemerg, R-Dieterich, opposed the bill, voicing concerns about the use of public resources for organizations like Planned Parenthood and questioning potential regulatory compliance interpretations by federal agencies. The bill is reported to have no fiscal impact on state resources, as stated by the Illinois Department of Public Health, and passed the House with a 69-36 vote.
