CMS Guidance on Medicaid Funding Restrictions for Noncitizens
The Centers for Medicare & Medicaid Services (CMS) have issued new guidance to help states prepare for upcoming restrictions on federal matching funds for Medicaid and the Children's Health Insurance Program (CHIP), specifically for certain noncitizens. Starting October 1, 2026, federal funding will be limited for individuals who fail to meet specified citizenship or nationality criteria as set by law. CMS Administrator Dr. Mehmet Oz highlighted the critical role of adherence to legal obligations. The recent State Health Official (SHO) letter under section 71109 of the Working Families Tax Cut legislation (Public Law 119-21) offers states comprehensive operational guidance on eligibility, verification, and claims processing. This initiative ensures that states have the necessary support to navigate these changes while maintaining compliance with federal funding requirements.
Despite these new restrictions, some exceptions exist, such as federal Medicaid matching funds for emergency medical treatments. States retain the option to cover lawfully residing children and pregnant women under Medicaid and CHIP, without affecting Health Services Initiatives under CHIP.
