Arkansas Insurance Bulletin: Pharmacy Network Adequacy Compliance
The Arkansas Insurance Department (AID) has issued Bulletin No. 2-2026, dated February 3, 2026, to clarify the submission processes for pharmacy network adequacy data. This move ensures compliance with 23 CAR pt 146, formerly Rule 118, emphasizing that insurers must meet existing regulatory compliance requirements without any additional stipulations for the next year. This bulletin guarantees continuity in reporting expectations, a crucial aspect for providers navigating industry regulations.
Annual Reporting Mandates
Under 23 CAR pt 146, all insurance issuers with a pharmacy benefit manager (PBM) are required to file an annual report on pharmacy network adequacy by March 1, unless it coincides with a weekend or state holiday—the deadline is then the following business day. The report must encapsulate data from the previous calendar year. For instance, insurers should submit data spanning January 1, 2025, to December 31, 2025, by March 1, 2026, adhering to regulatory deadlines.
Responsibilities and Submission Process
While PBMs can assist in compiling necessary data, the onus of timely and accurate submission lies with insurers. Carriers must utilize AID's "General Data Submission Process to RHLD" and follow the specified file specifications. This includes precise file naming conventions as detailed in AID’s “Reporting Data Specifications,” which are accessible on the AID website to ensure regulatory compliance. Accurate reporting supports risk management within the industry and underpins the integrity of claims processes.
