New Executive Order on Health Care Price Transparency
On February 25, 2025, a new executive order was issued by the White House focusing on health care price transparency, building on previous directives to health plans. This order requires immediate implementation and enforcement of healthcare price transparency regulations by the Departments of the Treasury, Labor, and Health and Human Services. It reinforces the 2020 ruling where health plans and insurers were mandated to make detailed cost-sharing information available through machine-readable files by January 1, 2024.
The 2023 guidance previously indicated that enforcement of these requirements would be evaluated case-by-case due to challenges faced by plans and issuers in reporting this data. The new executive order signifies a shift towards stringent enforcement to ensure compliance among health plans regarding the posting of required cost-sharing information. The administration is directing relevant departments to take necessary actions within a 90-day timeframe to monitor and enforce these compliance requirements.
