Guarantee Insurance Company Liquidation and Regulatory Compliance Update
Guarantee Insurance Company has been declared insolvent and ordered to liquidate by the Second Judicial Circuit Court in Leon County, Florida, effective November 27, 2017. In alignment with regulatory compliance requirements, Guarantee Insurance placed securities on deposit with the Virginia Department of the Treasury in accordance with Section 38.2-1046 of the Virginia Code. These deposits act as collateral for liabilities, impacting the Commonwealth of Virginia, residents insured by Guarantee Insurance, and other creditors.
In line with Virginia’s regulatory framework, the Virginia Property and Casualty Insurance Guaranty Association is obligated to manage certain claims against Guarantee Insurance. Following the payment of these claims, the Association possesses a statutory lien on the deposits of Guarantee Insurance. The Association has filed legal proceedings in the Circuit Court of the City of Richmond, Virginia (Case No. CL25-3709-00), to execute its lien rights and receive compensation from these deposits. The trial is set for January 29, 2026, at 9:00 a.m. at 400 N. 9th Street, Richmond, Virginia 23219.
