Florida Proposes HOA Reform Bill to Enhance Homeowner Control

Florida's legislature is considering a reform bill aimed at increasing homeowners' control over homeowners' associations (HOAs). The proposal, led by Rep. Juan Carlos Porras, would establish a Community Association court program for HOA disputes and empower homeowners with the ability to vote to dissolve their HOAs. This legislation intends to replace the current oversight by the Department of Business and Professional Regulation with judicial resolution. Florida has the highest number of HOAs in the U.S., encompassing nearly half of all homes in the state. While some experts note that HOAs already automatically dissolve every 30 years unless renewed, the bill seeks to provide more direct homeowner authority and improve accountability in HOA operations. The legislative session for this bill is set to begin on January 13 in Tallahassee.
