NY Supreme Court Allows Rollout of NYCE PPO Self-Funded Health Plan
New York County Supreme Court Judge Lyle Frank denied a preliminary injunction that sought to block the January 1 launch of NYCE PPO, a self-funded health plan managed by EmblemHealth and UnitedHealthcare's third-party administrator, UMR. The court ruled that the plaintiffs, including New York City employees, retirees, and advocacy group Hands Off NY Care, did not prove imminent or irreparable harm from the plan's rollout. The decision also highlighted ambiguity in New York City's administrative code and municipal law, leading the court to decline dismissing the city's motion against the lawsuit challenging the plan's legality.
